I am Mr. Hennagin's legal assistant and have worked with him for 15 years. Jens Jensen dismissed his prior lawyer who was representing him on the malpractice lawsuit against Jensen's former lawyer, Leonard duBoff, because the lawyer had filed two malpractice complaints against duBoff, both of which had been dismissed by the court. Mr. Jensen had paid the prior lawyer more than $66,000 in attorney fees to no avail. Mr. Jensen came to our office a week before a new complaint had to be filed in this very complex case against his former lawyer. Mr. Jensen signed a fee agreement whereby he agreed to pay a non-refundable retainer of $35,000 plus a contingent fee if Mr. Hennagin was successful on the malpractice claim against duBoff. As a result of Mr. Jensen's tardiness in retaining a new law firm (this firm) we did not have sufficient time to analyze the case thoroughly but were required to file a second amended complaint within the time prescribed by the court. When our complaint was also dismissed we filed an appeal and the Oregon Court of Appeals reversed the trial court's dismissal and permitted us to file a third amended complaint. This firm performed more than $60,000 worth of services on this case alone but had agreed to the $35,000 retainer so no other attorneys fees were ever claimed from Mr. Jensen on this case. In addition to this, we represented Mr. Jensen on four other matters including his claim against his former partner, Sid Harvey. In spire of having retained us on the case against duBoff in the fall of 2009 and knowing at that tie the he had claims against Sid Harvey, he did not retain us on the Harvey case until 2011. We are not responsible for the delay in filing the case against Sid Harvey. Mr. Jensen then terminated our services on the Harvey case just before trial was scheduled in order to buy more time for preparation by substituting another law firm for us at the last minute. We performed more than $40,000 of services on the Harvey case and three other cases for which Mr. Jensen has never paid us. In addition to that, the law firm that replaced us on the Harvey case has filed a lawsuit against Mr. Jensen for more than $110,000 in unpaid fees. Mr. Jensen has developed a reputation in the legal community for not paying lawyers for services he requests and for suing former lawyers for malpractice.
